Notes - By 1880, the family was back in the United States and in Maryland on the Elk Ridge Farm that Captain Janes had purchased shortly after Fanny's birth. Harriet was then pregnant with the fifth child. It was written that after Fanny was born, Harriet went through a post partum depression and Harriet's sister Katie spent most of 1869 on the farm helping out. Harriet became unstable once again with the birth of the baby. In depositions that came later, Janes wrote that Harriet would leave for several days at a time, taking the baby with her, and he came to depend on Fanny to manage the household and "was compelled to rely on his oldest daughter at the age of fourteen years."
Harriet accused Captain Janes of infidelities and her father insisted that she file for divorce. It was five years in and out of the courts before this was finalized in November 1884. Captain Janes denied the charges, and in fact nothing was ever proved that the charges were true and during this period, Fanny blamed the Scudders, Harriet's family, for the problems. In the final decree the judge gave Captain Janes custody of the three oldest children, Fanny, Henry and Lois.
