Notes - "Benjamin married Sarah______? circa 1697 (based on the birthdate of their oldest child) in Huntington. Benjamin and Sarah had eleven children, eight sons and three daughters (based on the listing in Benjamin's will dated 17 May 1732, probated 21 October 1739). Sarah died some time after 1715, and Benjamin married (2) Mary____?, widow of Robert Arthur. Benjamin died in 1735, about age 63." Some websites and online trees have made Benjamin's wife Sarah (unknown) into Sarah "Arthur" but there are no primary sources for this. This is definitely under review.
"Benjamin Scudder I, of Huntington, Suffolk County, New York (Long Island) [1]," D. B. Scudder, comp., Scudder Searches, v. II, no. 2, (Spring 1990): 3–8. This issue is careful to state that the surnames of both of Benjamin I's wives are unknown, but that his second wife Mary was the widow of Robert Arthur.
DISCUSSION: this widow of Robert Arthur would presumably not be his own sister Mary who was the wife of the Robert Arthur as mentioned in the 1690 will of Thomas (2) Scudder, (Thomas I (T), the immigrant.) Non Scudder Association sources such as WikiTree and online trees without sources make Benjamin's wife Sarah into a Sarah Arthur and his second wife Mary into a Mary Kelly but offer no citations. However, our attempts to find a primary source record that suggests either of these names for wives of Benjamin I yielded nothing. Efforts to find well documented Arthur and Kelly genealogies have so far also yielded nothing. Might these undocumented versions be based on misinterpretations of wife 1) Sarah _____? and wife 2) Mary, widow of Robert Arthur. Realizing there may be documentation that we have not seen, while this problem is under review wives Sarah and Mary will both be represented without maiden name until a primary source record is found to document their names. Please contact us if you have documentary proof of these maiden names.
Scudder Searches v. II (Spring 1990) issue corrects a mistake made in Scudder Searches, v. I, no. 2, p. 13 that estimates Benjamin's birthdate in 1658 which is much too early.
Benjamin was a prosperous mill owner in Huntington. No record of the date of his birth has been found; but, based on the date of the birth of his oldest child (1698), he probably was born about 1670/74 in Huntington, where his father had settled by 1660. Upon his father's death, Benjamin was appointed co-executor of the estate along with his mother, Mary Ludlam. He inherited most of his father's real and personal property in Huntington, which included the family homesite 'by the waterside' and all or most of his father's mills, also on the shore of Long Island Sound.
An abstract of Benjamin's will may be found in the Surrogate's Office, New York City, Abstract of Wills, Vol III, 1730–44, p. 255. Will made 17 May 1732. Children and neighbors mentioned include:
Son THOMAS, northwest part of old lot down the East Neck & a piece of woodland called a Hollow, joining to the rear of said Thomas Scudder's home lot, and joining east to Daniel Kelly...also a piece of meadow on the south side of the old mill dam, bought of Cornelius Smith & 20 acres of land acquired "by the Division before last." Thomas is to pay £60 to "my youngest son PETER before May 17, 1740;
& £10 to my son EZEKIEL. I leave to
my sons BENJAMIN and ISAIAH, each £10, both to be paid by
my son JACOB. I leave to my son Jacob 1/2 of my mill...And my son Jacob shall pay 'to my kind and loving wife Mary, 10 busheels of good wheat yearly.' I leave to
my son MOSES all that certain tract of land at...Wolf Pit Hollow...I leave to my son Moses my house and barn where I now live, and all my home lot and orchard, and all the woodland above my home lot, joining east to the highway that leads down the Great Neck, bounded south by my son Thomas, land that he bought of Major Platt, and partly by land of Thomas Jones and Daniel Kelley, and my son Benjamin Scudder, and Jonathan Whitaker...and partly by the lot I bought of John Canfield..."
Other neighbors whose properties bounded lands devised included Thomas Jarvis, Jr., and Mr. Garrett Van Horne, William Jarvis, Sr., Jonathan Wickes, William Johnson. Son Moses is to pay £40 to "my son Ezekiel, and £10 to
my daughter SARAH, wife of Epenetus Platt, Jr.; and £10 to my
daughter RUTH Rogers, and £10 to my son Isaiah.
My wife Mary is to have 1/3 of my orchard at my home lot, where I now live, and the west end of my house, 'with the privilege of the cellar; and kitchen to bake in and wash...
I leave to my daughter ANN, £50. I leave to my son Thomas 3/4 of a £100 right in the Old Purchase and in the Baiting Place Purchase. And to my sons Jacob and Moses I leave 1/2 of a £ 100 right in the same. I make my wife Mary and Daniel Kelly, executors. Witnesses, Charles Saxton, Jonathan Whitaker. Proved, October 21, 1739.
